Thai Prenuptial Agreements
When two people agree to keep their financial assets separate in the event that they may divorce of separate, it is commonly referred to as a prenuptial agreement. Also known as prenup or prenupt, this creates a level of security within a marriage. The prenuptial agreement makes divorcing much easier, quicker, and substantially cheaper to deal with. For example, in the situation where a party cannot agree on the splitting of the assets, or where one partner has ruined their credit score and has become blacklisted, the prenuptial agreement is increasingly convenient, as it only holds one partner responsible, instead of both. The boundaries of a prenuptial agreement are different in each country, however. Before you begin your marriage in Thailand, it is safest to acquire an attorney to draft your own prenuptial agreement. There are two categories upon which marriage falls: separate property or communal property. Separate property that is owned by either partner refers to their personal items such as gifts or tools, etc. Anything that has been acquired after the marriage, which belongs to solely one partner, husband or wife, is to be considered separate property. Communal property is acquired during the marriage and is jointly owned by both partners of the marriage. If any doubt arises as to which property belongs to whom, it will become communal property.
